WHEN EXECUTING LAWYERS ACTIVITY, A LAWYER IS OBLIGED TO ACT IN HUMAN WAY, RESPECTING DIGNITY OF ALL HE CONTACTS WITH. THEN, HE IS OBLIGED TO PRESERVE HIS HONOUR, MORAL CHARACTER, INDEPENDENCE AND EXPERTNESS IN ORDER TO STIMULATE OTHERS WITH HIS CONDUCT. WHEN EXECUTING LAWYERS ACTIVITY, A LAWYER IS OBLIGED TO RESPECT TRUTH AND LEGALITY, INDEPENDENCE OF LEGAL PROFESSION IN ACCORDANCE WITH THE CONSTITUTION AND LAWS. A LAWYER IS OBLIGED TO ENERGETICALLY REJECT ALL TRIES OF INFLUENCE ON HIS INDEPENDENCE IN EXECUTION OF ACTIVITY. HE IS OBLIGED TO INFORM ORGANS OF THE BAR ASSOCIATION ABOUT THESE TRIES. EXECUTION OF ANY COMMERCIAL OPERATIONS, ASSOCIATION OFLAWYERS OFFICES WITH ACTIVITIES OF SUCH EFFECT, I.E. ACTIVITIES THAT DO NOT GIVE LEGAL AID ARE INCOMPATIBLE WITH EXECUTION OF LAWYERS ACTIVITY. IT IS NOT APPROPRIATE THAT A LAWYER IS A PERSON THAT ACTS AGAINST INTERESTS OF LEGAL PROFESSION AND WHO DOES NOT RESPECT RULES OF THIS CODE.
Act on Emergency Measures in the field of Labour Market and Parental Care
The Act on Emergency Measures in the field of Labour Market and Parental Care (Official Gazette of the Republic of Slovenia, Nr. 63/2013; hereinafter referred to as the »ZIUPTDSV«) was adopted in mid-July and entered into force on 1 August 2013. As evident from Article 1 of the above mentioned act, it should provide for a provisional incentive for employment of younger unemployed persons in order to promote employment as well as for the provisional measure in the field of maternity leave compensation in order to contribute to the maintenance of transfer payments to individuals and households from the adopted budget of the Republic of Slovenia for 2013.
Notably the incentive for employers can be considered as particularly positive as it sets out that the employers shall be exempt from the payment of contributions for pension insurance and health insurance, parental protection insurance and unemployment insurance for a duration of two years if they give employment to a person under the age of 30. But it certainly also includes a requirement that the employer shall give a permanent employment to such person and must also fulfill additional requirements, namely:
That the employer did not start a procedure for cancellation of employment contract or did not cancel the employment contract to employee from business reasons in the last three months prior to the conclusion of the above mentioned contract;
That the employer did not have a current account frozen for 30 or more consecutive days prior to the conclusion of such employment contract and
That the employer has regularly paid salaries and compulsory social security contributions for the employees in the last six months prior to the conclusion of such employment contract.
Thereby it should also be noted that this measure applies for the time from 1 November this year to the end of 2014.
If we can affirm that the above mentioned solution was received positively, this can be no means be said for the second solution provided for in the ZIUPTDSV as regards the payment of maternity leave compensation. The amendment limits this compensation in such a way that it cannot be higher than twice the average gross monthly salary in Slovenia amounting to approximately EUR 2,800.00. Despite, this measure is defined as being provisional and shall apply from 1 August 2013 up to and including the year following the one in which the economic growth will exceed 2.5% of GDP.
