Zakon o urejanju prostora (ZUreP-2)

Z dnem 1.6.2018 se začne uporabljati nov Zakon o urejanju prostora (ZUrep-2), ki razveljavlja Zakon o urejanju prostora (ZUreP-1), Zakon o prostorskem načrtovanju (ZPNačrt) ter Zakon o umeščanju prostorskih ureditev v prostor (ZUPUDPP). V novem zakonu bo problematika urejena bolj celostno.

Nov ZUreP-2 nadgrajuje že uveljavljen sistem pravil o državnem in občinskem prostorskem načrtovanju ter ukrepe zemljiške politike, ki veljajo trenutno, vpeljuje pa tudi nekaj bistvenih novosti. V novem zakonu se želi predvsem krovno urediti področje, ter vzpostaviti jasen in pregleden sistem prostorskih aktov, predvsem na način, da se jasno ločijo strateški in izvedbeni prostorski akti.

Med drugim bodo v ZUreP-2 zbrana temeljna državna pravila glede urejanja prostora, drugi del pravil pa bo urejen v državnem prostorskem načrtu, ki bo torej vključeval ostala pravila, priporočila, smernice, primere dobre prakse ter standarde, ki so v uporabi pri državnem prostorskem načrtovanju in poseganju v prostor.

Z namenom racionalne rabe prostora, ki je eno izmed temeljnih načel, se v nov zakon vpeljuje pravilo vrednotenja vplivov posamezne prostorske odločitve na gospodarstvo, okolje in družbo. V zakonu je zato na novo določeno tudi načelo prevlade ene javne koristi nad drugo, v primeru, ko pride do navzkrižja interesov dveh javnih koristi. Pristojnost glede odločanja prevlade ene javne koristi nad drugo pripada Vladi RS.

Vzpostavlja se tudi režim poselitve s katerim se določijo ureditvena območja naselij, območja za dolgoročni razvoj naselja, enote urejanja prostora, določanje namenske rabe, določanje prostorskih izvedbenih pogojev, določanje gradbenih parcel, itd. Že sam zakon daje podlago za ohranjanje posamične poselitve pod določenimi pogoji, ki pa jih v občinskem prostorskem planu in občinskem prostorskem načrtu določi občina sama.

Ena izmed pomembnejših novosti so tudi podlage pri urejanju prostora za pripravo prostorskih aktov. In sicer zakon predvideva tri obvezne strokovne podlage:

  • urbanistično zasnovo, ki je obvezna strokovna podlaga za pripravo občinskega prostorskega načrta in se izdela za mesta in druga urbana naselja;
  • krajinska zasnova, ki je obvezna strokovna podlaga, za pripravo regionalnega prostorskega plana (ki je v ZUreP-2 prav tako novost) ali občinskega prostorskega plana, v nekaterih primerih pa tudi za pripravo občinskega prostorskega načrta;
  • elaborat ekonomike, ki je podlaga za pripravo in sprejem občinskega prostorskega načrta ali občinskega podrobnega prostorskega načrta, in v katerem se opredeli finančni vidik, ki je potreben za izvedbo občinskih ukrepov. Elaborat je potrebno pripraviti tudi za pripravo programa opremljanja stavbnih zemljišč.

Novost predstavljata tudi regionalni prostorski plan (pripravljen na ravni regije) ter občinski prostorski plan (pripravljen na ravni občine), ki sta strateška prostorska akta. Občinski prostorski plan, ki je obvezen le za mestne občine, bi naj sicer v osnovi nadomestil strateški del občinskih prostorskih načrtov ki pa lahko namesto v občinski prostorski plan preide tudi v regionalni prostorski plan.

Glede posameznih obveznosti občine so v ZUreP-2 določena prehodna obdobja. Namen zakona je predvsem, da občine opravijo analizo stanja prostora in kritično preučijo pobude za spremembo namenske rabe prostora, ter na ta način v občini določijo območja naselij, ureditvena območja naselij ter območja za dolgoročno širjenje naselij.

Zakon vzpostavlja tudi podlago, na podlagi katere lahko občine po novem obračunajo tudi takso za obravnavanje pobud za spremembo namembnosti nepremičnine, kadar je pobuda podana s strani zasebnega izvajalca.

Zakon daje občinam tudi možnost, da sprejmejo odlok o urejanju podobe naselij in krajin, ter jim tako v celoti prepušča pristojnost glede posegov v prostor kot so npr. gradnja enostavnih objektov, vzdrževanje objektov, urejanje javnih površin, plakatiranje, itd.

Za občine je pomembno tudi, da se vzpostavlja nov institut lokacijske preveritve, preko katerega bo lahko občina določila velikost stavbnih zemljišč pri posamični poselitvi, dopuščena bodo individualna odstopanja od prostorskih izvedbenih pogojev, s tem institutom pa bo omogočena tudi začasna raba prostora. Sam postopek lokacijske preveritve se sicer izvede na pobudo investitorja, ki pobudi priloži tudi elaborat lokacijske preveritve.

Nekatere druge novosti:

  • v zemljiško politiko se na novo uvrščajo tudi prostorski ukrepi;
  • nadgradi in prenovi se sistem predkupne pravice občine, ki se razširja tudi na državo;
  • novosti glede razlastitve in omejitve lastninske pravice;
  • novosti glede upravne komasacije;
  • spremembe glede razglasitve grajenega javnega dobra;
  • spremembe glede odreditve vzdrževanja;
  • spremembe glede soglasja za spremembo meje parcel v območju stavbnih zemljišč;
  • prenovljen sistem komunalnega prispevka;
  • vpeljava izravnalnega prispevka, ki daje podlago za zaračunavanje zaradi spremembe namenske rabe zemljišča;
  • sprememba ureditve gradbenih parcel, z namenom, da se zagotovi trajni obstoj pravic vsakokratnemu lastniku stavbe, ne le investitorju.
