Labour market reform in short

The National Assembly of the Republic of Slovenia adopted the new Employment Relationships Act (hereinafter referred to as “the ZDR-1”) and the Amendments to the Labour Market Regulation Act (hereinafter referred to as “the ZUTD”) on 5 March 2013. Both acts entered into force with certain exemptions on 12 April 2013.

One of the greater novelties provided for in the ZDR-1 is certainly the amendment of the fixed-term and permanent employment system with the aim to promoting permanent employment and weakening the fixed-term employment. A major novelty is firstly the severance pay to which also an employee who concluded a fixed-term employment contract (after the entry into force of the ZDR-1) is entitled, and secondly the incentive for employers for the conclusion of permanent employment contracts with shorter period of notice and lower amount of severance pay in case of employment contract cancellation due to business reasons or grounds of incompetence. The amendment to the ZUTD should also be mentioned in this connection, in accordance to which the employer, who concludes a fixed-term employment contract with the employee, shall pay the employer’s contribution for unemployment insurance scheme in the amount of five times the amount defined by the law regulating the social security contributions, for the entire time of fixed-term employment. The time will show whether these amendments will influence the employers in such a way so as to actually conclude more permanent employment contracts but it can be most certainly said that the labour market reform will have positive effects on a certain segment of employees the rights of whom were minimum prior to the amendments to the ZDR-1. The novelty is also the reimbursement of costs to voluntary apprentices and the temporary regulation of protection of economic dependants.

The amendment of the system of annual leaves can be considered as specifically important since it was regulated rather incomprehensible in the past and is now significantly simplified. In view of eliminating administrative obstacles for the employers, the amendment for more flexibility regarding the dismissal procedure should also be mentioned as the act eliminates the compulsory service of notice of the intended cancellation of employment contract from business reasons as well as clarifies and regulates in detail the way of the service of dismissals which in the past practice was many times controversial.

The above mentioned novelties present only a part of amendments made by the labour market reform. Determining the details and consequences of the amendments takes time and the courts will play an important role in the establishment of the settled case-law.
