OTHER ORGANIZATION ACCORDING TO THE DECISION OF THE BAR ASSOCIATION, AND THE BAR ASSOCIATION BEARS THE COSTS. IT IS NOT APPROPRIATE THAT A LAWYER IS A PERSON THAT ACTS AGAINST INTERESTS OF LEGAL PROFESSION AND WHO DOES NOT RESPECT RULES OF THIS CODE.

Payroll – the employee’s right and the employer’s obligation

 

The payroll, well-known to all employees, has experienced a not so huge but still very desirable change for many employees with the new Employment Relationships Act (ZDR-1). The above mentioned payroll which the employer must deliver to the employee by the end of the payday in accordance with paragraph 2 of Article 135 of Employment Relationships Act, is now defined by this Act as »written calculation« and a very special rule is foreseen for it.

Paragraph 3 of the mentioned Article 135 of Employment Relationships Act namely defines that the written calculation is an authentic document on the basis of which the employee can lodge court enforcement. This in practice means that on the basis of information arising from payrolls enforcement can be lodged against the employer on the basis of an authentic document, which will then be examined by the Central Department for Authentic Documents organized within the Ljubljana Local Court. As the mentioned department is organized in a way so as to examine the matters quickly, the employee who lodges such request for enforcement can expect a swift issuing of the enforcement order, in most cases within a few days.

It shall however be taken into consideration that the employer has the right to appeal against the issued enforcement order, which he shall file within eight days. If the court rules that the appeal of the employer is reasoned and that he as obligor has stated the facts justifying the appeal as well as submitted evidence, it will set aside such enforcement order and instruct the employee as creditor to assert his claim before the competent labor court. If the employer as obligor does not appeal or submit reasoned appeal, the issued enforcement order shall become final, meaning that the enforcement order will be handed over to competent institutions and bodies which will enforce the enforcement order if this will be possible considering all circumstances.

In this connection it should be pointed out that paragraph 1 of Article 135 of the Employment Relationships Act sets out that the salary shall be available to the employee on a certain payday. As a general rule, the payday is specified in the contract of employment or collective labor contract; however, if the payday is not specified in the contract, paragraph 2 of Article 134 of the Employment Relationships Act applies. This paragraph sets out that the salary shall be paid out no later than within 18 days after the expiration of the payment period. Accordingly, if the salary is not available to the employee on a certain payday, the employer is already overdue and the employee has the right to lodge the before mentioned request for enforcement on the basis of the authentic document.

Probably, this possibility will gradually be increasingly applied in the practice, especially now when the amendments to the Court Fee Act were adopted. According to these amendments, court fee shall now also be paid for all proceedings for individual labor disputes with property character, whereas this fee is of course much higher in case of higher claims than the court fee paid in the case of the procedure for enforcement on the basis of authentic document as this fee remains the same, irrespective of the amount of money in the enforcement procedure. Despite the above mentioned, it should be noted that in case of setting aside the enforcement order and instructing the employee and the employer before the labor court, the employee must pay the court fee.

At the end it should also be mentioned that, as already said, the employer is obliged to deliver the payroll to the employee no later than by the end of the payday. If the employer shall be in breach of this obligation, the Labour Inspectorate of the Republic of Slovenia may impose a fine for such breach. Thus, the delivery of payroll is the right of the employee on the one hand and on the other hand, it is certainly also the obligation of the employer, the violation of which could also result in an inspection procedure at the employer.
