IT IS NOT APPROPRIATE THAT A LAWYER IS A PERSON THAT ACTS AGAINST INTERESTS OF LEGAL PROFESSION AND WHO DOES NOT RESPECT RULES OF THIS CODE.

Amendments to the Legal Protection in Public Procurement Procedures Act

 

The first amendments to the Legal Protection in Public Procurement Procedures Act (ZPVPJN-A) entered into force on 10 August 2013 and bring about some desirable as well as a good deal of key amendments.

The amendment to the provision of Article 5 is particularly radical as it changes the definition in paragraph 1 as to when it is admissible to file a request for revision from the primary statement »against any action of the contracting authority« to the definition »against action of the contracting authority in violation of the rules, which has or could have a significant impact on the award of contract”.

Another fundamental amendment of Article 5 is also the new obligation of the tenderer, related to the compliance with active legitimacy, that when he wishes to file the claim for legal protection relating to the contents of the publication, invitation to tender or tender documentation, he or eventual other tenderer shall previously warn the contracting authority through the Public Procurement Portal of the alleged violation.

The novelty is also preferential ruling of the National Review Commission on the requests for revision due to violations of the procedure for the award of public contracts, co-financed under European funds.

Furthermore, the amendments to the Legal Protection in Public Procurement Procedures Act define higher charges, except for some exemptions when the charge amounts to EUR 1,000, inter alia, if the request for revision relates to the services in the List of Services B or to open competition.

The most desirable novelty is the possibility to request the recovery of the half the court fee if the applicant withdraws his request for revision after receiving the decision from the contracting authority, with which his request for revision was refused, but prior to the decision of the National Review Commission.

Otherwise, the amendments brought just a few changes or novelties; however, these are the more important. The fundamental change of provision of Article 5 can in particular bring many new situations in practice as it does not solve them consistently and therefore, we will obviously solve them again through practice and time.
